RPost Sues AOL and Yahoo!

Other parties may be named in lawsuit

LOS ANGELES, CA—October 20, 2009

RPost®, the global pioneer in email proof services with its flagship Registered Email® service technology, announced today that it has brought suit against AOL and Yahoo! for patent infringement, adding their names to its ongoing litigation against Goodmail Systems. RPost has asked the US Federal Court to issue an injunction to prevent further damages.
 
RPost’s flagship Registered Email® service provides senders legally valid and court admissible evidence of email content and delivery. RPost is suing Goodmail for infringing RPost Patents with its "Certified Email Paper Suppression" service.
 
Goodmail partners with several ISPs to allow corporate advertisers to by-pass the spam filters that protect users from unwanted advertising in return for a fee. Goodmail Paper Suppression is a new Goodmail offering that claims to give proof of email delivery to those ISPs.
 
"Goodmail's core service is to allow advertisers to buy their way into users' inboxes," says Zafar Khan, CEO of RPost. "That's not the business we're in. The RPost system is for proving the delivery and contents of high value business email, not spam. Goodmail is trying to enter our market with its Paper Suppression (PS) Product.  But Goodmail PS infringes RPost patents and it does so in a way that requires participating ISPs to collaborate with Goodmail in that infringement."
 
RPost is adding AOL and Yahoo! to this lawsuit because Goodmail has publicly identified them as participants in the Paper Suppression system.
 
Asked if any other Goodmail partners were likely to be added to the suit, Khan said, "Goodmail claims that several of its current partners are going to add PS in the next few months.  We suggest that they evaluate RPost’s patents before taking any actions that would permit Goodmail to expose them to collaboration in Goodmail’s patent infringement.” Khan continues, “while Goodmail has publicly stated its intent to willfully steal and sell RPost technology, we would like to believe that Goodmail’s partners would not want to be lured into such reckless actions and disregard for well established intellectual property law.”
 
RPost’s 24 patents granted worldwide have priority over technology dating back to 1996. These patents broadly cover the technologies of verifiable proof for email delivery and value-added outbound email processing. RPost patents have been granted in Australia, Austria, Belgium, Canada, China, Denmark, France, Germany, Ireland, Italy, Korea, Luxembourg, Mexico, Netherlands, Portugal, Spain, Sweden, Switzerland, United Kingdom, and the United States; with numerous additional patents pending.
